Key Requirements for Ancillary Accommodation in the Shire of Toodyay
- Maximum Size: The ancillary dwelling must not exceed 70 square meters in internal floor area.
- Occupancy: It should be occupied solely by members of the same family as the main dwelling.
- Design Compatibility: The design and appearance must be similar to the existing house to maintain aesthetic harmony within the locality.
- Location: The ancillary dwelling should be located within 20 meters of the main house and positioned behind or in line with the building line of the existing house.
- Parking: An additional car parking space is required for the use of the occupants of the ancillary accommodation.
- Water Supply: If reticulated water is not available, the ancillary accommodation must have an additional 22,500 liters of potable water supply, in addition to the 92,000 liters required for the existing residence.
Planning Approval Process for Ancillary Dwellings Exceeding 70 Square Meters
If you propose to build an ancillary dwelling larger than 70 square meters, planning approval is required. The application process involves:
- Pre-Application Consultation: Engage with the Shire's planning department to discuss your proposal and understand specific requirements.
- Application Submission: Submit a detailed application, including plans and supporting documentation, to the Shire.
- Assessment: The Shire will assess the application against the Local Planning Scheme and relevant policies.
- Decision: The Shire will decide to approve, approve with conditions, or refuse the application.
- Notification: If approved, a Section 70A Notification will be registered on the property's certificate of title, indicating that the ancillary accommodation is for family use only.
